{"id":1063,"date":"2021-08-10T10:12:00","date_gmt":"2021-08-10T13:12:00","guid":{"rendered":"https:\/\/gnl.com.br\/?p=1063"},"modified":"2021-08-10T10:12:00","modified_gmt":"2021-08-10T13:12:00","slug":"vetado-projeto-de-lei-que-implica-em-relacoes-locaticias","status":"publish","type":"post","link":"https:\/\/gnl.com.br\/eng\/vetado-projeto-de-lei-que-implica-em-relacoes-locaticias\/","title":{"rendered":"Vetado Projeto de Lei que implica em rela\u00e7\u00f5es locat\u00edcias"},"content":{"rendered":"\n\n\n<p>Vetado pelo Presidente da Rep\u00fablica, no \u00faltimo dia 4, projeto de Lei que estabelece medidas excepcionais no cumprimento de medida judicial, extrajudicial ou administrativa que resulte em desocupa\u00e7\u00e3o ou remo\u00e7\u00e3o for\u00e7ada coletiva em im\u00f3vel privado ou p\u00fablico e a concess\u00e3o de liminar em a\u00e7\u00e3o de despejo para estimular a celebra\u00e7\u00e3o de acordos nas rela\u00e7\u00f5es locat\u00edcias.<\/p>\n\n\n\n<p>Os principais motivos justificadores do veto, conforme mensagem foram:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Os impedimentos descritos na proposi\u00e7\u00e3o legislativa poderiam consolidar ocupa\u00e7\u00f5es existentes, assim como ensejariam danos patrimoniais insuscet\u00edveis de repara\u00e7\u00e3o ou danos ambientais graves que poderiam ser cometidos no per\u00edodo de vig\u00eancia da propositura;<\/li><li>Descompasso com o direito fundamental \u00e0 propriedade, tendo em vista que, ao propor a suspens\u00e3o do cumprimento de medidas judiciais, extrajudiciais ou administrativas nas rela\u00e7\u00f5es locat\u00edcias, conduziria a \u201cquebras de contrato\u201d promovidas pelo Estado e aumentaria o risco da atividade imobili\u00e1ria, com a consequente possibilidade de aumento dos pre\u00e7os dos alugu\u00e9is, al\u00e9m de poder potencializar a inadimpl\u00eancia do setor.<\/li><li>Contrariedade ao interesse p\u00fablico, uma vez que muitas fam\u00edlias, especialmente, as de baixa e m\u00e9dia renda, adquirem im\u00f3veis como sua fonte de sustento, seja proveniente de aluguel, seja de arrendamento, seja para cultivo pr\u00f3prio.<\/li><\/ul>\n\n\n\n<p>Desse modo, a lei proposta possibilitaria melhorias para o problema dos posseiros, mas, por outro lado, agravaria a situa\u00e7\u00e3o dos propriet\u00e1rios e dos locadores.<\/p>\n\n\n\n<p>Agora, na sequ\u00eancia, \u00e9 aguardada a an\u00e1lise do veto pelo Congresso Nacional.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Vetado pelo Presidente da Rep\u00fablica, no \u00faltimo dia 4, projeto de Lei que estabelece medidas excepcionais no cumprimento de medida judicial, extrajudicial ou administrativa que resulte em desocupa\u00e7\u00e3o ou remo\u00e7\u00e3o for\u00e7ada coletiva em im\u00f3vel privado ou p\u00fablico e a concess\u00e3o de liminar em a\u00e7\u00e3o de despejo para estimular a celebra\u00e7\u00e3o de acordos nas rela\u00e7\u00f5es locat\u00edcias.
